《民法典》视角下工程款债权转让风险及应对

摘要:首先,分析、识别工程款债权转让过程中的风险,主要体现在司法管辖、转让合同效力、建设工程价款优先受偿权等方面。然后,针对债务人和债权受让人提出应对工程款债权转让的建议和风险规避措施,以此确保债权转让合法有效。

Risks and Countermeasures of the Assignment of Project Fund Creditor’s Rights from the Perspective of Civil Code

Abstract: This paper analyzes and identifies the risks in the process of assignment of creditor’s rights,which are mainly reflected in the jurisdiction,effectiveness of transfer contract,construction project price priority right of compensation and other risks.Then,puts forward relevant suggestions and risk aversion measures for the debtor and creditor’s right transferee to deal with the transfer of creditor’s rights of project payment,so as to ensure the legitimacy and effectiveness of the transfer of creditor’s rights.
